PMDD Rehab

Please read the Terms of Use for PMDD Rehab carefully and in their entirety before purchasing and interacting with PMDD Rehab. PMDD Rehab and its content are owned by Her Mood Mentor LLC.

1.  Definitions:

“Company”, “We”, “I”, “Our”, or “Us” means Her Mood Mentor LLC “Participation”, “Participating”, “Using”, or “Use” means reading, implementing, implementing, trying, or otherwise engaging in PMDD Rehab.

“You” or “Your” means the purchaser and person using the Challenge.

 

2. Consent:

By participating in PMDD Rehab, you implicitly and voluntarily agree to act in accordance with, agree to, and abide by, these Terms of Use.

 

3. DISCLAIMER:

By participating in PMDD Rehab, you understand that Jes Hagan is a Nutritional Therapist, Integrative Menstrual Health Coach & Educator.

 

PMDD Rehab is for informational and educational purposes only. The information and education provided in PMDD Rehab is not intended or implied to supplement or replace the professional advice of a medical or mental health provider. 

Although we do our best to make sure all of PMDD Rehab’s content is up to date and/or accurate, we do not make any representation that all the information is accurate or free of errors at all times. We do not assume any responsibility for the accuracy of PMDD Rehab’s information, or its safety or efficacy as it applies to you.

 

4. Assumption of the Risk

You should use your best judgment in using the information provided in PMDD Rehab, which is done at your own risk. It is your responsibility to discern the risk of using PMDD Rehab or its content. You assume responsibility for your actions, choices, or lack thereof, related to PMDD Rehab. 

 

5. Intellectual Property Ownership:

PMDD Rehab and its content, including, but not limited to, the live calls, recordings of the calls, screenshots, slideshows, challenges, homework, and anything on the Facebook page, Youtube links, or in Kajabi are intellectual property owned by Jes Hagan and Her Mood Mentor LLC  Any violations of this term, and all terms contained herein, will be legally pursued to the fullest extent permitted by law.

 

Any use of the Company’s intellectual property may not be used in connection with the sale or distribution of any product, program, challenge, and/or service by you, directly or indirectly, without the prior written consent of Her Mood Mentor LLC.

 

Misappropriation or unauthorized use of the Company’s intellectual property and/or trade secrets may result in the enforcement of an infringement and/or intellectual property theft action against you in an effort to recover damages and/or protect our intellectual property rights. The Company reserves the right to pursue an action for misappropriation, theft, or improper use of its intellectual property by You, Your representatives, assigns, contractors, employees, or acquaintances.

 

6. No Sharing:

You cannot distribute, copy, forward, and/or share PMDD Rehab or its content with anyone else. Any violations of these Terms of Use will be legally pursued to the fullest extent permitted by law.

 

You may not share your password or login information with anyone. You also may not share the Facebook group or any links to recordings with anyone. If you share your password to Kajabi, Facebook group access, or login with anyone who did not purchase PMDD Rehab, you will be removed from PMDD Rehab immediately and no refund will be issued. 

 

7. No Claims Made Regarding Results:

Any and all current or past-client testimonials, statements, or examples used by us are simply that: examples. They are not guarantees that you will also experience or receive the same results. Each person and his/her circumstances are unique and nothing shall be interpreted as a guarantee that you will experience the same results as another client of ours. 

We don’t make any assurances as to any particular financial-based outcome based on the use of or participation in PMDD Rehab. We are not responsible for the success or failure of your symptom reduction, symptom management, health choices, or any other result of any kind that you may have as a result of your participation in the PMDD Rehab.

 

8. DISCLAIMER - No Warranties, Guarantees, or Representations Are Being Made:

We do not offer any representations, guarantees, or warranties, of any variety, regarding PMDD Rehab in any way including, but not limited to, your future health, symptoms, or injury derived as a result of your use of PMDD Rehab. PMDD Rehab is offered “AS IS” and without representations, guarantees, or warranties of any kind, including but not limited to, implied warranties of merchantability and fitness for a particular purpose, neither express nor implied, to the extent permitted by law.  We are not liable for damages of any kind related to your use of PMDD Rehab.

 

9. Your Release of Us, Indemnification, Hold Harmless:

To the fullest extent permitted by law, Her Mood Mentor l LLC expressly disclaims liability for any direct, indirect, and/or consequential damages suffered by you related to your purchase or use of, or participation in, PMDD Rehab, its materials, our website, or any other information obtained by you from us. By enrolling in PMDD Rehab, you hereby agree to this limitation of liability and release Her Mood Mentor LLC from any and all claims.

By participating in and/or purchasing PMDD Rehab, you agree to release, forgive, forever discharge, defend, indemnify, and hold harmless Her Mood Mentor LLC, our subsidiaries, employees, agents, contractors, subcontractors, shareholders, directors, officers, coaches, assignees, licensees, and affiliates from any and all claims, suits, actions, charges, demands, liabilities, damages, judgments, and/or costs, related to, or arising out of, your purchase of or participation in PMDD Rehab and/or your breach of any obligation, warranty, covenant, or representation set forth in these Terms of Use. 

By enrolling in PMDD Rehab, you agree to release us from any and all claims and further agree to at all times defend, indemnify, and hold harmless Her Mood Mentor LLC as stated in this section herein.

 

10. Our Refund Policy:

We will do everything within our ability (and within reason) to ensure your satisfaction.  We will give you a full refund and let you keep the 4 bonus handouts if you don't get see results after working through PMDD Rehab*. 

 

*If you work through PMDD Rehab and don’t see any results, meaning you’ve watched all videos within the course and completed and presented all homework assignments, and attend 1 of the 4 live student calls from the course modules we will refund you in full let you keep the 4 bonus handouts  (PMDD Partner, Tame Your Inner Critic, EDC Recipe Guide, Hormone Healthy Recipes) for free. No Chargebacks:

You will not, under any circumstances, issue or threaten to issue any chargebacks to the Company or your credit card and/or form of payment (ie, PayPal or Stripe) for any reason whatsoever related to PMDD Rehab. In the event of a chargeback, the Company reserves its right to report it to the credit bureaus as a delinquent account.

 

11. ARBITRATION CLAUSE:

If you have any complaints or should any issue arise in the use of PMDD Rehab, please contact us directly first by emailing Jes at [email protected].

 

However, if we are unable to amicably resolve your dispute in that manner, you agree that you and Jes + Her Mood Mentor LLC shall submit your dispute to binding arbitration with the American Arbitration Association, before an arbitrator that is mutually agreed upon, in accordance with the American Arbitration Association’s (“AAA”) rules.

 

By agreeing to this term, you hereby agree and understand that you are waiving your right to a jury trial in court, which would otherwise be available to you if not for this Arbitration Clause. Should any arbitration hearing need to be held, it shall be held within 50 miles of Kalispell, Montana.

If the arbitrator issues an award and a judgment is made, the judgment will be binding and will be entered in court in the State of Montana. The only award that can be issued to you is a refund of any payment made to Her Mood Mentor LLC for the applicable course or service. You are not permitted to seek additional damages, including consequential or punitive damages.

 

12. Limitation of Liability:

Jes Hagan and Her Mood Mentor LLC are not responsible or liable in any way for any and all damages you receive directly or indirectly from your participation in PMDD Rehab. We do not assume liability for damages, injuries, harm, death, misuse of (or failure to properly use) PMDD Rehab or its content, due to any act, or failure to act, by you. IN NO EVENT SHALL WE BE LIABLE TO YOU FOR ANY INDIRECT, SPECIAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES.

 

13. PAYMENT AND PURCHASE

General Payment Terms: 

When you pay for PMDD Rehab by credit card, you authorize and give permission to Her Mood Mentor LLC to charge your credit or debit card for the amount owed for payment of PMDD Rehab. When you purchase PMDD Rehab, your information (i.e. credit card and contact info) may be collected by the third-party merchant Stripe, PayPal, and Kajabi (depending on the payment method you choose at checkout), who may have privacy policies or security practices that are different than ours. Her Mood Mentor LLC is not responsible for the merchant’s independent policies or practices.

 

14.   Severability 

The provisions of these Terms of Use shall be deemed severable, and the invalidity or unenforceability of any provision shall not affect the validity and enforceability of any other provision hereof. If any Section, subsection, sentence, or clause of these Terms of Use shall be adjudged illegal, invalid, or unenforceable, such illegality, invalidity, or unenforceability shall have no effect on the Terms of Use as a whole or on any Section, subsection, sentence, or clause hereof not expressly so adjudged.

 

15. Entire Agreement

These Terms of Use contain the entire agreement between you and the Company. There are no other promises or conditions in any other agreement (oral or written) between you and the Company.

 

16. Choice of Law + Venue

These Terms of Use shall be governed by the laws of the state of Utah. Any action brought by any party arising out of or from these Terms shall be brought within the Flathead, County of Montana.

 

17. Photograph and Testimonial Release

You grant the Company the right, title, and interest to share any and all communications, wins, screenshots of communications, or testimonials in connection with your participation in PMDD Rehab for the purposes of promoting and marketing PMDD Rehab across social media, advertisements, the Company's website, and to the Company's future clients. You understand that you will not receive any compensation for the use of your likeness, testimonial, or image. The Company will make all reasonable efforts to conceal your identity unless otherwise granted permission by you to share your name or identifying information. 

 

18. Payment Plan & Default Policy

 

1. First Missed Installment: Notification of Payment Update

 

In the event of a missed installment for the online course hosted by Kajabi, the user will promptly receive an email notification requesting an update to their payment method. It is the user's responsibility to ensure that their payment details are accurate and up to date to avoid any disruption in course access.

 

1. Second Missed Installment: Reminder Email for Payment Update

 

Upon a second missed installment, Kajabi will send a reminder email to the user, prompting them to update their payment information at their earliest convenience. Timely resolution is advised to maintain uninterrupted access to the course content.

 

1. Third Missed Installment: Temporary Product Access Revocation

 

Should the user miss a third installment, access to the course product will be temporarily revoked until the user communicates with us via email to confirm the update of their payment method. It is imperative that the user initiates this communication to facilitate the manual reinstatement of access.

 

Please be reminded that it is the user's responsibility to keep their payment information current to avoid any interruptions in their online course experience. Her Mood Mentor shall not be held liable for any inconvenience arising from the failure to update payment details on time.

 

By continuing with the enrollment and usage of the online course hosted by Kajabi, the user agrees to adhere to these terms regarding missed installments and the subsequent actions taken to resolve the matter. Her Mood Mentor reserves the right to modify these terms and conditions at its discretion, with prior notice to the users.
